Liability for nursing home abuse

Nursing home abuse can be hurtful to victims and their families when the care of a loved one has been entrusted to a nursing home. For that reason, victims of nursing home abuse and their family and loved ones should be familiar with the legal resources and remedies available to protect them when they have been harmed in a nursing home.

Liability for nursing home abuse

Nursing homes can be liable for nursing home abuse that occurs in their facility in a variety of different ways including for:

  • Negligent supervision and care – if the nursing home fails to properly supervise or care for the loved one and they wonder off and are harmed, for instance, or suffer from bedsores, as another example, the nursing home may be liable for negligent supervision and care of the resident victim.
  • Negligent hiring and retention of employees – if the nursing home is negligent in its hiring and retention of employees, by hiring and retaining an employee despite a history of abuse, for example, the nursing home may be liable for negligently hiring and retaining that employee and for the harm they caused.
  • Negligent maintenance of the premises or failing to secure the premises – if the nursing home fails to properly maintain the nursing home for the safety or residents, or fails to provide adequate security, it may be liable for harm to nursing home resident victims that results.
  • Negligent selection or maintenance of equipment – if the nursing home is careless in its selection of equipment used in the facility, or fails to property maintain the equipment used in the facility, and it causes harm to resident victims, the nursing harm may be liable for the victim’s damages.

As mentioned, there are several different ways that a nursing home may be liable for failing to keep a loved one safe while in its care.
